SleekCMS Terms of Service

Please read these terms carefully before using SleekCMS.

These Terms of Service ("Terms") are a legal agreement between you ("you" or "User") and SleekSky LLC, a California limited liability company ("SleekSky," "we," "us," or "our"), the maker of SleekCMS. By creating an account or using SleekCMS, you agree to these Terms.

1. The Service

SleekCMS is a hosted content management and static site building platform. We provide the software, infrastructure, and hosting. You provide the content.

2. Your Account

  • You must be at least 18 years old to create an account.
  • You are responsible for keeping your login credentials secure.
  • You are responsible for all activity that occurs under your account.
  • One person or legal entity may not maintain more than one free account.

3. Acceptable Use

You may use SleekCMS only for lawful purposes. You may not use the service to:

  • Publish or distribute illegal, defamatory, harassing, or abusive content
  • Infringe any third-party intellectual property rights
  • Transmit malware, spam, or other harmful code
  • Attempt to reverse-engineer, scrape, or overload our infrastructure
  • Resell or sublicense the platform without our written permission

We reserve the right to suspend or terminate accounts that violate these rules.

4. Your Content

  • You own the content you create and publish through SleekCMS.
  • You grant SleekSky a limited license to store, process, and deliver your content solely to operate the service.
  • You are solely responsible for ensuring your content does not violate any laws or third-party rights.
  • We do not sell your content or use it to train AI models.

5. Plans, Billing & Cancellation

  • SleekCMS is offered on Free, Plus, Business, and Enterprise plans. Current pricing is available at sleekcms.com/pricing.
  • Paid plans are billed monthly or annually in advance. All fees are in USD.
  • No refunds are issued for partial billing periods, unless required by applicable law.
  • You may cancel your plan at any time. Cancellation takes effect at the end of the current billing period.
  • We reserve the right to change pricing with at least 30 days' notice.

6. Free Plan

The Free plan is provided as-is, with no uptime guarantee. We may modify or discontinue the Free plan at any time with reasonable notice.

7. Intellectual Property

SleekCMS, its design, code, and trademarks are owned by SleekSky LLC. These Terms do not grant you any rights to our intellectual property beyond what is needed to use the service.

8. Uptime & Support

  • We aim for high availability but do not guarantee 100% uptime on standard plans.
  • Enterprise customers may negotiate custom SLAs separately.
  • Support is provided via email at [email protected] according to your plan level.

9. Data & Privacy

Your use of SleekCMS is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using SleekCMS, you consent to our data practices as described there.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SLEEKSKY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA OR PROFITS, ARISING FROM YOUR USE OF SLEEKCMS — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

12. Termination

We may suspend or terminate your access to SleekCMS at any time if you breach these Terms. You may terminate your account at any time by contacting [email protected]. Upon termination, your right to use the service ends immediately.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in California.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the SleekCMS dashboard. Your continued use of the service after the effective date of the updated Terms constitutes acceptance.
